Open Public Hearing: Chairperson Strout opened the public hearing at 6:15 p.m. Manager Doane briefly explained the Town of Bradley General Assistance Ordinances Appendices A, B, & C for years 2007-2008. She provided copies for council members.

The winter parking regulations will be the same as the previous year. The ban will be from November 1, 2007 to April 15, 2008. Manager Doane confirmed that any Council member has the authority to call law enforcement about any violations regarding this ban.

Town Council Meeting

Town Council Present: Sally Strout, Audrey Wilcox, Frederick Gifford, Lillian Coulter and Oscar Emerson.

Municipal Staff: Town Manager, Melissa Doane, Virginia Oakes as note taker, and Fire Chief Eric Gifford

Public Present: None

Review of Minutes:

  1. Councilor Gifford motioned to accept the minutes from 9/18/07 council meeting as presented. Motion seconded by Councilor Wilcox. Manager Doane pointed out 2 clerical errors that were corrected. Vote 3-0. Motion carried.
  2. Councilor Gifford motioned to accept the minutes from 10/2/07 council meeting as presented. Motion seconded by Councilor Strout. 3-0. Motioned carried.

Manager Report:

  1. The City of Bangor sent Manager Doane a permit count of 25 for the household hazardous waste clean up. The total cost is not yet known. Neil Bonneville has expressed interest in next year’s household hazardous waste clean up. He has a HAZMAT license to deliver hazardous waste. Neil is willing to obtain other licenses if needed. The clean up could be cheaper next year if Bradley collaborated with other towns such as Milford and Eddington. Manager Doane is going to check with Maine DEP for further specifications.
  2. October 5th Manager Doane met with Red Shield to discuss the STACK testing that occurred in June 2007. Councilors Wilcox and Gifford attended with Manager Doane. Results from the tests showed Red Shield had a 3-day average of .098 lbs. per hour of lead. They are allowed to run at 1.06 lbs. per hour. Red Shield stated that 45% of what is burned is construction debris and 55 % green wood chips. More STACK testing is scheduled for November. The STACK testing is not conducted by Red Shield; an outside company does it. Manager Doane spoke to Senator Rosen on a separate occasion and he stated that he would be glad to come and talk to the Town Council about a monitoring system.
  3. Manager Doane met with Old Town Housing Authority regarding housing or other needs in the area upon recommendation of Chris Shum from Eastern Maine Development Corporation. He is going to pursue a planning grant for the ball field area. Manager Doane pointed out that much revenue would be lost with the removal of the dam. She further explained it would be in the best interest of the Town to pursue avenues that generate revenue to replace this loss. It is estimated that about $50,000 per year in taxes will be lost which would equal about 1 mil.
  4. Manager Doane met with Randy Bragg of Carpenter Associates regarding the culverts on Boynton Street. He examined the culverts and did not agree with S.W. Coles’ conclusion that a liner be used. The bottom of culvert is rotting out and the water is going under the culvert and if a liner is placed in it, the water is still going to go under the liner. Different contractors have been contacted. Manager Doane and Randy Bragg met with Shane from Maine Earth. Shane is going to give an estimate for replacement of the culverts. He also believes that while the replacement is taking place, one lane can remain open.
  5. Manager Doane shared that Municipal Review Committee works with PERC regarding solid waste and they are looking for a candidate to sit on their board of directors. Manager Doane asked if any Council members were interested. No members were interested.
  6. Manager Doane will attend a FEMA meeting on October 18, 2007 regarding a grant for the fire department.
  7. Chairperson Strout and Manager Doane attended a meeting Tuesday hosted by Bangor Chamber of Commerce regarding the school consolidation. Alan Smith updated Manager Doane on Bradley’s status. A facilitator, Mrs. Burnstien, has been hired to help facilitate the meetings with the committee. The State of Maine is paying for the facilitator. So far the only letter of intent that was accepted by the Commissioner was the one that involved Old Town, Union 90, Orono, Veazie and Glenburn. However Mr. Smith feels that Orono, Veazie and Glenburn do not want to pursue this option therefore he feels the Union 90 and Old Town option may be our choice.
  8. Manager Doane spoke to Todd Stevens about the cemetery restoration. He is in hopes to start November 1st.
  9. Dan from D and H Construction has agreed to do the plowing for the Town at $34000 for the year giving special consideration to Elm Street. Dan is going to walk Elm Street with Manager Doane to discuss how snow removal will be handled.
  10. Peter Currier is interested in plowing the municipal building parking lot and the fire station about the same as last year.
  11. Fire Chief Gifford approached Manager Doane about a junior fire-fighting program. MMA has confirmed that they would be covered under the general liability and workman’s comp. There would no extra charge this year but next year there would be because it would be considered an added liability. Manager Doane has asked Chief Gifford to talk with other towns to see what they have for a junior fire-fighting program.
  12. The cost for Juniper Ridge clean up this past Saturday came in at $526.00. Last year’s fall clean up was $1873.00. The tonnage collected was about the same as last year as well.
  13. Regarding Brown Street, Brick Hamilton hasn’t responded to Manager Doane’s calls or emails.
  14. Neil Bonneville interested in cleaning up junkyard. He would charge us $475.00 per load and he would rent a pulp loader to shake out the dirt. It is estimated that about 3 loads could be taken. Councilor Wilcox motioned to hire Neil Bonneville to clean up at 686 Main St. with the amount of funds available. Motion seconded by Coulter. Vote 5-0. Motion carried.

New Business:

Chairperson Strout motioned to post the Winter Parking Regulations as discussed at the Public Hearing. Motion seconded by Councilor Gifford. Vote 5-0. Motion carried.

Councilor Gifford motioned to accept the General Assistance ordinances Appendices A, B, and C for the years 2007-2008 as presented by the State of Maine and discussed at the Public Hearing. Motion seconded by Councilor Coulter. Vote 5-0. Motion carried.

Councilor Gifford voiced concern about stuff being left outside near 81 Main Street that normal trash pick-up will not accept. Manager Doane reported that the current piece out on the lawn has a "for sale" sign on it and it is next door to 81 Main Street. The couch was picked up and taken to the fall clean up by a town employee. Manager Doane did not feel it was a problem, however will speak to the property owner.

Unfinished Business:

Emerson motioned to not allow excess excise credit as a result of vehicle transfer as stated in 1.36 MRSA section 1486 sub section 5 (LD227). Motion seconded by Councilor Gifford. Vote 4-1. Chairperson Strout nay.

Municipal Warrants:

Councilor Coulter motioned to accept Warrant #31 for $3471.77 and Warrant #32 for $13,272.46. Motion seconded by Chairperson Strout. Vote 5-0. Motion carried.

Next Meeting: October 30th, 2007 @ 6:30 p.m.

Executive Session: Chairperson Strout motioned to enter into executive session pursuant to 1 MRSA section 405 subsection 6D to discuss Town Manager Contract. Motion seconded by Councilor Gifford. Vote 5-0. Motion carried.

Councilor Emerson motioned to exit executive session pursuant to 1 MRSA section 405 subsection 6D. Motion seconded by Councilor Coulter. Vote 5-0. Motion carried.

Councilor Emerson motioned to amend the Town Manager’s Contract to include family coverage at the PPO Value Plan level for the remainder of the contract. The funds of $2678.00 will be transferred from the Bond Anticipation account. Motion seconded by Chairperson Strout. Vote 5-0. Motion carried.
