TOWN RIGHT OF WAYS
Any item placed within the Town’s right of way is at the owner’s risk. Any item such as mailboxes, landscaping, land markers, basketball hoops need to be placed as far as possible off the roadway and right of way. Generally the Town’s right of way is 25’ from the centerline of any road.
Maine State Statute (29-A MRSA § 2396), states that it is unlawful to place in the Town’s right of way any snow or slush that has not accumulated there naturally. Violations of this type are enforceable by the State Police and or County Sheriff’s and prosecution is handled by the District Attorney. In addition Maine State Statute (23 MRSA §§ 3252 and 3253) makes it a civil violation to obstruct the flow of water in ditches or drains along the public ways. This civil violation is punishable by a fine of up to $500, up to three months imprisonment or both. Therefore it is very important when plowing and performing spring and fall clean up, to keep the clean up on your property.
